Texas law that shapes a purchased MVA case
Filing deadline: two years from the date of injury for personal injury and wrongful death claims (Civil Practice and Remedies Code § 16.003), unchanged in 2025. A purchased case with an old accident date leaves your firm less time to work it.
Fault: Texas uses proportionate responsibility with a 51% bar. A claimant more than 50% responsible recovers nothing, and lower shares reduce damages (§ 33.001). The 2025 tort bill S.B. 30 did not pass.
Insurance: Texas is a fault state with 30/60/25 liability minimums (Transportation Code § 601.072). Every policy includes $2,500 of personal injury protection and uninsured/underinsured motorist coverage unless the insured rejects it in writing, so ask whether PIP and UM/UIM were rejected when you review the file.
Texas solicitation and referral rules to check before you buy
Barratry is a third-degree felony under Penal Code § 38.12, and since September 1, 2025 (H.B. 2733) it expressly covers solicitation by social-media direct message and other electronic contact. Unrequested written solicitations about a personal injury matter are barred until the 31st day after the accident.
A client may void a contract procured through barratry (Government Code § 82.065), and since H.B. 4325 a person who was solicited but never signed can recover a $50,000 penalty from each barrator (§ 82.0651). Disciplinary Rule 7.03(e) bars paying non-lawyers for soliciting or referring clients, comment 13 sets the conditions for paying lead generators, and Rule 7.06 bars keeping a case obtained improperly.
Texas allows only government or nonprofit lawyer referral services to be certified (Occupations Code ch. 952), and Ethics Opinion 561 treated a for-profit service that forwards consumers to paying lawyers as an uncertified referral service. Ask any Texas vendor how claimants are contacted and how its fee is triggered, and have your ethics counsel review the answers.
What a Texas signed MVA file should include
Texas crash reports are privileged: unredacted copies go only to people involved, their authorized representatives, owners, insurers and other listed recipients (Transportation Code § 550.065). Ask how the vendor obtained the report and accident details in the file.
For commercial-vehicle cases, note that Texas requires bifurcated trials on a timely defense motion (Civil Practice and Remedies Code ch. 72). Agree in writing what reaches your intake team: the signed agreement, signing record, intake answers, PIP and UM/UIM status, and open questions.
